Lawsuits are in progress while current president Donald J. Trump issues bans on particular media sources on White House grounds. CNN, MS NOW, and POLITICO have been victims of these bans, bringing attention to the negative implications on Pool Coverage, causing pushback for the coverage of the President’s September 21st event with New York Mayor Zohran Mamdani. The continuous narrative of the president of these sources providing “fake news” has been a point of discussion since the beginning of his term, which has led many to question to what extent bans like these could violate the First Amendment.
On September 18th, President Donald J. Trump spoke regarding “fake news” presented by news outlets such as CNN, MS NOW, and Politico. After White House Aide Natalie Harp, who some might say feeds the president’s current events intake, has been the main cause of this ban on the media. Criticism of Trump’s administration is not surprising, but when you are one of the largest companies presenting current news surrounding the administration in the United States, you open Pandora's box!
As there are no “legal” standards for the prior publication of news articles published by media outlets, the media industry relies on ethical standards and post-publication groups to keep sources accountable for the "validity" of media being published. Media Sources such as The Guardian report that these three outlets have filed a restraining order against the U.S. Government to temporarily lift the ban. This lawsuit isn’t necessarily to attack Donald Trump or his administration, but because of the belief that the American public has the right to access independent journalism, the right to the Free Press, and Free Speech. During his term as president, Trump has sued these sources for cases of libel and slander, some of which he was successful in and others not so successful, but the banning of media sources from White House grounds was abrupt but predictable.
In the 2022 Case of Trump v. Cable News Network, Trump claimed CNN engaged in terminology that “defamed” him in his statements presented in his 2020 presidential election. CNN denoted that his statements were a “Big Lie” during his campaigns. According to The U.S. District Court for the Southern District of Florida, CNN has used terminology more than 7,700 times since his presidential election in 2020 to diminish his political legitimacy.
CNN, along with other news sources, usually reports these negative descriptions based on his monitored actions, not based on false actions/narratives based on bias. The U.S. District Court for the Southern District of Florida noted that CNN did not constitute a “false statement of fact” but did present unverifiable opinions and rhetoric that is protected by the First Amendment.
Going back, could the 2026 news media ban be another example of Donald Trump not liking the opinions of current journalism?
At Donald Trump's meeting event with Mayor of New York, Zohran Mamdani, they discussed the ban of certain media outlets, the democratic party and how the party is behaving while midterm elections are around the corner, effects of the Warner Bros. Discovery and Paramount Skydance merger, and critiques of Israeli prime minister Benjamin Netanyahu and his presentation at the 81st UN General Assembly, and Immigration and affordable housing projects for their constituents. Mayor Mamdani mentions he had put aside differences that conflicted with President Trump's ideas to continue this meeting. Mamdani had opened the floor for these banned media outlets to join them during the meeting on Monday.
“What I said is that I believe in a free press, and I believe in the importance of engaging in questions from all, no matter whether they are based in a compliment or on a critique,” - Mamdani via CNN
After commentary from Mayor Mamdani when asked about Trump’s media ban. Trump further mentioned that the press and the public denote “a boycott” against him, but he was not worried about it. Later in his commentary, he mentioned that the “press also is an obligation” to the people, then further went on a tangent on the economy and his win during the 2024 presidential election.
If the president was not worried about pushback from the press, why ban it from the grounds of the White House? Is this a strategy from the president? If it is a strategy from the president, it would be contradictory to his actions and his words. Throughout the president’s time mentioned in the press, one can denote his contradictions throughout time. According to Time Magazine, in the 1987 article titled “Politics: A Trump Card?”, it stated that Trump did not have any intention of running for president, yet he ran for president during the 2016, 2020, and 2024 elections and became president in 2016 and 2024. Other examples of his contradictions can be found in the Politico article “Donald Trump’s Greatest Self-Contradictions”.
Negative publicity is not always false publicity. Freedom of speech and freedom of the press are principles promised to us in the Constitution. These bans do not change the narratives about the president brought by these outlets, nor should they allow the silencing of the voices and opinions of the public. Fear is not shown; persistence against powerful political entities and initiatives that go against deterrences are evident. Protests within corporations and within communities have been notable during the president’s administration and will continue. This is the first amendment into play.
UPDATE (SEPT 24, 2026):
According to NBC News, after CNN, MS Now, and Politico brought a lawsuit to the government, the courts have decided to temporarily lift the ban off these news outlets and let them exercise their freedom of press on the whitehouse grounds. Their 14 day lift does not mean a permanent lift as the lawsuit is still in process, but a small progress to this ban. It was also reported by NBC News that although the temporary ban had been lifted, reporters are still not being let on White House grounds.
The question is why? The courts have granted a temporary lift, why wouldn’t the White House comply with issuance of the courts? The reason for why the White House is being prohibited to enter is unknown, but throughout this administration, we’ve seen many instances where the president has defied federal court orders. An official settlement date has not been issued, but the question is, will this lawsuit be in favor of these news outlets or the President? If in favor of the president, could this mean other news outlets can be barred from reporting on whitehouse grounds? Could there be more negative results than a ban? To what extent could the result of this lawsuit lead the industry?
